Prior to the adoption of CP 6-1 on 06/08/2010, Policy 6-1 read as follows.


DISTRIBUTION:    Mayor and City Council

SUBJECT:    Granting additional time for compliance with Building Codes on condemned structures.

PURPOSE:    To establish a consistent procedure for the City Council on granting additional time for compliance with Building Codes.

BACKGROUND:    Title 11, Section 22-122, of the Oklahoma Statutes, authorizes a municipal governing body to cause dilapidated buildings to be torn down and removed in accordance with certain provisions and procedures.

The Building Development Department is responsible for Code compliance of vacant structures within the community.  After exhausting all available remedies for Code compliance with the property owner/s, staff initiates the necessary procedure for removal of the dilapidated structure and schedules a public hearing before the City Council.

During the public hearing, the owner/s or other interested party(ies) may request additional time to rehabilitate the structure.

POLICY/
PROCEDURES:    1.    If during the public hearing a request is made by the owner/s or other interested party(ies) for     additional time to rehabilitate the structure, the Council will table any action to a date and time     certain.

2.    Within three (3) working days following the request for additional time, the owner/s or other interested party(ies) shall submit to the Building Development Department the following:

A.    A detailed list of proposed improvements to be accomplished eliminate Code violations.

B.    A detailed work schedule as to when the list of improvements will be accomplished.

C.    If someone other than the owner/s is making the request, documentation shall be submitted stating the interest of the other party(ies) in the property.

3.    The Building Development Department will be available     to discuss the Code violations with the owner/s or other interested party(ies) in developing the detailed improvement list.  Staff will advise the owner/s within three (3) working days, after submission of the requirements listed in Number two (2) above, as to whether the proposed list of improvements will correct all Code violations.

4.    The request of the owner/s or other interested party(ies), for additional time, will be placed on the next available Council agenda for consideration.

The Council will consider the detailed improvement list and the time schedule before granting a specified time to rehabilitate the structure.

5.    A.    After the elapsed time granted by the Council, staff will advise the Council of the         disposition of the dilapidated structure.

B.    Providing the structure complies with City Code requirements, no further action will be taken, and Council will be advised by memorandum of the structure.

C.    If the structure does not comply with City Code requirements, staff will prepare a resolution for adoption by Council, to cause demolition of the structure.

EFFECTIVE DATE/
RESCISSION:    This policy became effective December 13, 1994.  This version updates the format and assigns a new number to Council Policy No. 67.
